Copyright & Licensing
All photographs, video and other visual content displayed on or supplied through this website are protected by Australian and international copyright laws.
Unless otherwise agreed in writing, copyright in all work created by Asanka Brendon Ratnayake remains the property of the photographer. Purchasing, downloading or commissioning images grants a licence to use the work only. It does not transfer copyright or ownership of the underlying intellectual property.
If the terms of an individual client contract or licensing agreement differ from the information on this page, the terms of that written agreement will take precedence.
The following terms apply to all licensed imagery unless superseded by a separate written agreement.
Copyright Ownership
All copyright and intellectual property rights remain with Asanka Brendon Ratnayake.
No copyright is transferred through the purchase, licensing or commissioning of photographs or video unless expressly assigned in writing.
Clients receive permission to use licensed material only within the scope of the licence granted.
Rights Managed Licensing
Rights Managed licences are issued for specific uses and may include restrictions relating to:
publication or campaign
print or digital media
geographic territory
duration of use
print run
exclusivity
Any use outside the agreed licence requires written approval and may incur additional licensing fees.
Royalty Free Licensing
Where imagery is supplied under a Royalty Free licence, clients receive a non exclusive, perpetual licence for the approved use.
Royalty Free licences do not permit the resale, redistribution, sublicensing or inclusion of the original files within stock libraries, templates or products intended for resale.
Copyright remains with the photographer.
Editorial Use
Editorial imagery may only be used for genuine news, editorial or documentary purposes.
Images must not be used in a manner that implies endorsement, sponsorship or association by any identifiable person, organisation or brand unless written permission has been obtained.

Commercial Use
Commercial advertising, promotional and marketing use requires an appropriate commercial licence.
Where applicable, model or property releases will be supplied only where specifically stated.
The client is responsible for ensuring that any intended use complies with all relevant laws and industry regulations.
Print Purchases
The purchase of a photographic print transfers ownership of the physical print only.
No copyright or reproduction rights are included.
Prints may not be scanned, copied, reproduced or used commercially without prior written permission.
Personal Downloads
Images supplied for personal use may be stored, displayed and shared for private, non commercial purposes.
They may not be:
sold
redistributed
licensed to third parties
used commercially
entered into stock libraries
Image Alterations
Reasonable cropping, resizing and colour correction are permitted where appropriate for the licensed use.
The following are prohibited without written permission:
removing watermarks or copyright notices
removing embedded metadata
creating misleading or defamatory alterations
using imagery within logos or trademarks
reselling or redistributing original files
Artificial Intelligence
Unless expressly authorised in writing, photographs or video supplied by Asanka Brendon Ratnayake may not be used to train, develop, fine tune or improve artificial intelligence systems, machine learning models, image generators, datasets or similar technologies.
This restriction applies whether the material is used directly or indirectly.
Payment
Licences become valid only once payment has been received in full unless otherwise agreed in writing.
Failure to pay an invoice may result in the immediate suspension or revocation of any licence granted.
Limitation of Liability
Every effort is made to ensure the accuracy and quality of supplied material.
Except as required under Australian Consumer Law, all photographs and video are supplied without additional warranties.
Liability is limited to the amount paid for the relevant licence.
Unauthorised Use
Any use of imagery outside the scope of the granted licence may constitute copyright infringement under Australian copyright law.
Unauthorised use may result in the suspension of licences and legal action to recover damages, licensing fees and associated costs.
Governing Law
These terms are governed by the laws of the State of Victoria, Australia.
Any disputes arising from these terms or the use of licensed material will be subject to the jurisdiction of the courts of Victoria.
